N. Burnie outlined the application noting the request of a reduction in parking from 90 to 85 spaces on the retained lot. He clarified the severed lot will contain the correct number of spaces. T. Blanchard spoke to the application and noted that legal is now registering the easements as required. He explained the severance is primarily a financial exercise in order to secure funding as needed for Phase 2. Paul Gray of 52 Garden Street, owner of the adjacent property sought clarification on how this development will affect his property. He asked if there is required green space and questioned if the space at James and Garden would remain. He noted the property line in question abuts his house and askes if there are any setbacks required for privacy/risk. Mr. Gray spoke of a sewer line that runs under the green space earlier identified. He asked if the City will require the developer to install privacy fence or consider the privacy of the resident(s) in the area. In response to the questions raised, N. Burnie provided the following: 1. The original Site Plan was approved two to three years ago; Changes to this including green space would have to follow a set procedure; 2. Setbacks are not required in the Downtown and Waterfront central area; 3. Sewer line - no sewer line was identified on Garden Street; 4. There is no requirement for privacy fence, but there is for safety. THAT application A16/24 be approved, and the following variances be granted: Retained lot on Garden/Pine/
